The 12 year old can not be sued (thats propoganda from the "were stupid so were entitled" club) Her parents can and should be since they are responsible for what goes on in their house, or for crimes committed by under-age children.
Theft is theft. The girl should have been brought up better than to steal. Funny, I've seen all age groups saying they "did not know" that theft was illegal . . .

I think a lot of kids are going to start recording their own songs in the garage...and pump them out to the public. This will cause alot of problems for the industry to figure out what is licensed or protected....and what is simply your own act. Looking around the US...I bet that there are 20,000 musical groups who have no record contracts...and need public exposure. Someone ought to start a site to get people to down load the unknown group songs.

The premise of "thou shalt not steal", I can agee with. However I think this fall's in the "grey area" category. I to thought that it was legal or I wouldn't have let my kids do it (actually I didn't even know they did it till I read about it and asked them). But once I learned that there could be legal reprecussions I instructed them not to do it. But hell I still don't know that it's illegal. Yeah, yeah I know the fat cat's in music industry are calling it illegal, but we shall see.
