I understand that time IS of the essence in this matter, but one still wonders why petitioners did not begin at the Circuit Court level. Better yet, why they didn't file this action AND get another petitioner to simultaneously file a similar/identical action in the Circuit.

They filed identical cases in District Court and at the Supreme Court. The Supreme Court ruled first.
