I still don't understand why Bush did not just "recess appoint" him. Could he still do it? Or is Estrada gone from consideration forever?

I read on a thread yesterday that a recess appointment only lasted until January 2005.

It was also UNPAID.

If I am remembering this wrong someone please correct but if I am remembering correctly that a recess appointment is unpaid it would obviously not be in Mr. Estada's interest to accept.
