I found this in post 2550. Are we sure a judge counts as a public official (in this context) ?

-------

112.52 Removal of a public official when a method
is not otherwise provided.--

(1) When a method for removal from office is not otherwise provided
by the State Constitution or by law, the Governor may by executive
order suspend from office an elected or appointed public official,
by whatever title known, who is indicted or informed against for
commission of any felony, or for any misdemeanor arising directly
out of his or her official conduct or duties, and may fill the
office by appointment for the period of suspension, not to extend
beyond the term.

(2) During the period of the suspension, the public official shall
not perform any official act, duty, or function or receive any pay,
allowance, emolument, or privilege of office.

(3) If convicted, the public official may be removed from office by
executive order of the Governor. For the purpose of this section,
any person who pleads guilty or nolo contendere or who is found
guilty shall be deemed to have been convicted, notwithstanding the
suspension of sentence or the withholding of adjudication. (4) If
the public official is acquitted or found not guilty, or the
charges are otherwise dismissed, the Governor shall by executive
order revoke the suspension; and the public official shall be
entitled to full back pay and such other emoluments or allowances
to which he or she would have been entitled had he or she not been
suspended.

It sounds to me that Jeb could at least TRY to suspend Greer even if he lacks the authority to do so. I think he would have legal authority. But first he must show how Greer has been in collaboration with Schiavo and Felos. That should not be hard to do.

So why won't Bush act? If Greer is "Republican," could that be the reason? How could saving a disabled woman from dehyration and starvation cause him to lose that many votes in a future race? If he won't act when he can, I must seriously question his "reputation" for being "prolife."

Since Greer is an elected official, I think this is very possible. MarMema, do you know the statute that allowed Governor Gilmore to get involved in Virginia?

thanks for finding it....

From your post 4765 (bolding added):

112.52 Removal of a public official when a method is not otherwise provided.-- (1) When a method for removal from office is not otherwise provided by the State Constitution or by law, the Governor may by executive order suspend from office an elected or appointed public official, by whatever title known, who is indicted or informed against for commission of any felony, or for any misdemeanor arising directly out of his or her official conduct or duties, and may fill the office by appointment for the period of suspension, not to extend beyond the term.

To me this implies that Greer has to be formally charged with a misdemeanor or a felony in order for Jeb to be able to use this order. Obviously I'm not a legal person, but this is what it sounds like to me.

But like pc93 just stated, it may no longer matter for Terri since Greer has already ruled on this case. However...if charges could be brought up against Greer and this case could be appealed to whichever court might be appropriate, perhaps in that regard Greer's decision could be overturned by the higher court. I have no idea really, I think I'm just trying to brainstorm ways for Terri's case to go.

After seeing Pat Anderson on O'Reilly last night, she looks to me like she will do everything in her power to help Terri. I don't think she'll leave any stone unturned. Her only difficulty may be that she has so much work to do, so much to manage, that she could use a lot of assistance in making sure that everything is filed properly.
