How about "Willful derelection of duty" in re the management of her guardianship and "Abuse (by derelection of duty) of an Elderly or Disabled Person?" - by not enforcing the already funded and court mandated rehabilitation? Is that doable?

Conspiracy to commit fraud? Again, the guardianship/rehab money. As I understand it, he has blatantly allowed Michael Schiavo to discard the court's orders for rehabilitation as well as allowing over $400,000 to be spent on something other than what another court earmarked it for. Surely there's got to be something there. If only getting one judge ticked at another...lol

I think this federal suit represents Terri's best hope.

Let's hope they can come back with a re-write on it that the judge likes.

My husband just told me that Greer can no longer rule on the removal of the tube on the 11th, he has to wait until the federal court issue is completed ( and it seems like they would be wanting to come back on the federal filing right at the end of it to give themselves the most time).

So that means the 11th is no longer a date to be concerned about, correct?

Most people seem to think (and I believe the Judge has stated) that he will just set the date further in the future to allow time for the Federal case to be followed to its conclusion. Isn't that just dandy...a little cocky, no?

Well at least they are on the right track now, and working under a different judge. It was about the rights of the disabled all along, imo.

My next question is when and how do they balance the issues of health care surrogate against family rights/legal guardianship?

Has Terri had a health care surrogate assigned to her?

I agree with your statement regarding the Gibson report. I pointed it out to illustrate the difference between his and Hannity's report. Gibson DID report the story, but put the wrong 'face' on it without ample facts.

Felos should not be the 'face' of this case. Hannity helped put Terri's face on the story by inviting her family for the interview. It's not about Felos....it's about Terri.

Terri hasn't even had her teeth brushed in years. Nor a pap smear, never had a mammogram.

Could you explain more about a 'health care surrogate'.

Kimmie, it seems to me like Governor Bush wishes all this "Terri stuff" would just go away, and it will by Sept. 21 or so. He has written the letter, and I bet that's all he intends to do, knowing full well that George Greer would not even read the letter. I have no hope at all that Bush will try to suspend Greer and create another judicial firestorm. The Bushes do not like controversies to emerge on their watches. Were Bush to suspend Greer, it is possible that the hospice will not legally recognize Greer's "suspension" and proceed full speed with the starvation.

On the contrary, he worries that legislative involvement might open the door to further restricting patient and family rights.

"All we need is for the Supreme Court in this state to rule that surrogates can remove artificial feedings from terminally ill patients and patients in a persistent vegetative state."

Rather than lobbying for laws, Dr. Smith said, he would like to see Missourians march on the state capital to protest "the hundreds of thousands of dollars spent to care for patients in persistent vegetative states and the money spent to hire private lawyers to block families from doing the right thing." He shared his experiences as a doctor who has helped patients and families who wanted to withdraw respirators, tube feeding and other life-sustaining treatments in Missouri, one of the states with the most restrictions on when such care can be withdrawn...."

I followed the link you posted for Florida law and there was a section on health care surrogates.

I agree with you on Greer. It seems to me like the federal judge was the one who is open to listening and thinking about this, having given the Schindlers time to come back with an apparent "fixed mistake" in their first filing.
That judge might be sympathetic....to nice letters to him.

Funny how this neuro said it this way,when what I think he really worries about is if the health care surrogates stop the removal of tube feedings, not bring them on.

I think kimmie7 has the image, I just have to check out a different thread. It's pretty quiet on Free Republic today but that's typical for a Sunday. It will pick up after Dubya speaks and the Dems do their rebuttal.

The hearing is for 10 a.m. Thursday. It is possible that the Thursday A.M. feeding will be Terri's last, or perhaps the Thursday evening feeding. There is nothing we can do, as all appeals have been exhausted. No one will take the initiative to save this poor soul. They do not consider her "quality of life" worth saving. We are reaching the point where miracles can no longer happen in this case.

There is still that one chance, I think, that civil rights and the ADA will come through. Keep the faith.
