I filed a EEO complainant on March 26, 1996 with the U.S. Justice Dept. against the Federal Bureau of Prisons for alleged discrimination as a Vietnam Era Veteran pursuant to the Vietnam Era Readjustment Assistance Act of 1974, 38 U.S.C.Section 2012. which requires employers to take positive steps to enable veterans to be consideed for employments opportunities such as promotions, training and pay. 38 U.S.C. 4212. Hence, under the statue, not only are employers precluded from discriminating against Vietnam Era Veterans, they are also required to take positive steps to enable veterans to be considered in promations and other employment opportunties. The EEO investigator in my case failed to address this issue and never able to discern whether I suffered discrimination as a veteran, or failed to receive consideration for my veteran status when I applied for a position. I contend that I was a victim of discrimination based upon the failure of the agency to consider my veteran status notwithstanding the fact that I was the most qualified candidate for the job. I am still fighting this case
