[Arizona Supreme] Court: State must cover care for illegals

The Arizona Supreme Court has rejected a plea by the state's Medicaid provider to limit medical coverage for illegal immigrants to emergency room and acute care.

The Arizona Health Care Cost Containment System, or AHCCCS, manager of the state's Medicaid program, is obligated to provide care to illegals beyond emergency room and other acute care wards, justices ruled unanimously Thursday.

According to Capitol Media Services and the Arizona Daily Star, AHCCCS – which currently pays $75 million to $80 million a year in emergency care for illegals – had refused to reimburse hospitals for services it said were not covered. About one-third of that amount is covered by state taxpayers; the federal government covers the rest.

I guess more AZ public hospitals will start closing their doors. In a way the AZSC made the right call. The situation of uncompensated medical care simply can't continue.

Let the Arizona judges themselves PAY for this outrage with their own dollars and NOT THOSE OF THE TAXPAYERS AND LEGAL CITIZENS.

Brooke Adams, a candidate for Governor in California wrote this in response to someone who objected to her stand on cutting off services to illegal aliens. I guess which is why the Arizona Supremes never got around to reading it:

Your thoughtful message deserves a thoughtful response. While you and I will probably never agree on the issue of illegal immigration, let me share my thoughts with you. When I say on television that we must cut programs, it is because our state is in crisis. We are like a ship sinking and we are going down under the weight of programs that, regardless of how well-intentioned, we simply cannot afford. It's that simple. We are going down. We are in a fight for the economic survival of our state.

Of course I recognize that many illegal immigrants do work that other Americans do not and of course I recognize that immigrants toil long hours and of course I recognize that prices for many goods and services might rise without their cheap labor. But you obviously understand that illegal immigrants do much more than pick produce. They use services, very expensive services, which are being provided at little or no charge to them.

You and I pay health insurance. Our employers pay health insurance. As you yourself aptly point out, many of these very expensive services are provided at no charge to illegal immigrants. As much as I would like to help others in society, we simply cannot afford to provide these services to millions and millions of illegal immigrants, many of whom come precisely because they know that being here is the way to obtain these critically necessary human services. It's very noble of us to do that for our fellow human beings, but we are going down the economic financial drain by doing so. Certainly you can see that.

As for the Domestic Violence programs, which again, are admirable programs, let me share this with you: My father is an Orange County Judge. I have witnessed him in court. Every single day, he sees dozens upon dozens of illegal immigrants who are in court, and/or in custody, with expensive interpreters, expensive public defenders (or expensive alternate public defenders when their are two co-defendants), expensive deputy district attorney's, court reporters, court clerks and bailiffs. All of these state employees, paid for by you and me, the people who pay state taxes, are providing services to illegal immigrants not entitled to be in California and not here legally. This is just one courtroom in one county on any one day. Did you know that there are almost 1,600 judges in California hearing dozens and dozens of these cases every single day? We are talking about a system that is breaking down.

This is just one example, of which there are hundreds. We have state bureaus that deal with illegal immigrant needs, hospitals that deal with illegal immigrant needs and many, many other agencies that provide very expensive services for which there is zero income taxes being paid for. Yes, I know that illegal immigrants pay sales taxes and gas taxes, as you and I do, but these as you know go for many of the local services that they also use extensively in local cities and on roads.

At some point, we have to say, as a society, enough is enough. When is that point? I submit to you that we have reached that point. If California, the 5th largest economy in the world goes under, what does that bode for you? Me? Or our nation? Our the world? I would say dire consequences, at the very least and a world recession at worst.

Again, I thank you for your thoughtful response. I have traveled the world. I have seen poverty and I am disheartened by human suffering. But I believe we can do more good in the world as a vibrant economy rather than a sick society trying vainly to tap legal citizens to continue to provide services to illegal immigrants.

"The road to ruin is paved with good intentions." I believe we are on the road to ruin in California and while my heart is with the underprivileged, my head says that we have an obligation to future generations, not to mention the national and world economies, not to sink. Life is about tough choices. While you may see my views as unkind, actually they are very kind. We will do more good as a strong society, building economic ties to foreign countries, so that they can be strong too, and so that their citizens do not stream across our borders for work and services.

Are those judges totally unaware of the budget crisis in California? We cannot keep handout out taxpayer money to every indigent from third world countries. More will come and the system is crashing.

18 POINT ACTION PLAN: Border Violators

1) Close all US borders to illegal entry forthwith by any and all means possible, including military presence.

2) Maintain legitimate immigration levels at modest annual level with requirements that immigrants be employable or sufficiently wealthy for self-support if they do not intend to work, proficient in basic English and willing to be assimilated into American culture and language. All applicants shall provide prints, photos and DNA samples.

3) Legal immigration shall be awarded to individuals on a lottery basis, wherein all countries are given equal status in the immigration lottery, without regards to color or economic plight of originating nation.

4) Individuals of Islamic faith (muslims) from any country shall be denied immigration privileges or entry into the US. Christians and Jews from muslim countries fleeing religious persecution shall receive preferential and accelerated immigration privileges.

5) Detain all border violators, taking photos, prints and DNA samples of said violator while at the same time, checking for out standing warrants. If no warrants are outstanding, return border violators to home country within 20 days via commercial airline and submit cost of such action, including processing and housing costs for said violator, to country of origin. If costs are not paid within 30 days, reduce any and all aid to said country by a like amount.

6) Should any country from which a border violator originates not currently receive any aid from the US, the Justice Department shall be authorized to seize or secure liens on assets owned, managed or registered to that country to the full extent of the obligation.

7) Establish new Guest Worker Visa (GWV) category, renewable every six (6) months, for unskilled labor positions wherein all applicants shall provide prints, photos and DNA samples. Work permitted of such applicants shall be limited to one of several categories, including childcare, lawn/gardening, restaurant staff, cleaning, and the like. Families of GWV workers are not permitted to enter US, nor will the birth of a child to one of GWV status confer citizenship to either parent or child.

8) Any violation of civil or criminal laws shall result in the forfeiture of the GWV and immediate return to originating country.

9) GWV holders shall be prohibited from claiming unemployment benefits, welfare support or free medical service.

10) The originating country of all GWV holders shall be responsible for any uninsured loss caused by the GWV, including emergency medical claims and/or claims resulting from illegal actions committed while in the US.

11) Companies who hire GWV holders shall submit to the Immigration Dept the name and GWV number of that individual, along with a description of employment tasks. Companies shall be subject to fines and penalty that fail to report employment of GWV workers, or hire border violators. GWV workers shall be paid with check, having income tax withheld. GWV workers shall not be subject to unemployment tax because they are not eligible to receive unemployment compensation.

12) Border violators, or any non-citizen not possessing a valid visa, detained by local police for any reason shall be turned over to border control officials for immediate deportation action, except if they face criminal charges in other jurisdictions.

13) Border violators and GWV workers shall be prohibited from voting in local, state and federal elections.

14) Border Violators shall NOT be afforded the rights enjoyed by American citizens, as guaranteed under the constitution.

15) Public education (at institutions supported by taxpayer dollars) at any level (pre-school, kindergarten through the university level,) shall NOT be available to Border Violators (or children of Border Violators) and schools that enroll such individuals shall be subject to penalties.

16) Foreign Students (F/S) (individuals admitted to the U.S. for the purpose of attending any educational facility,) private institution or public (i.e. supported by taxpayer dollars,) must have valid student visas, such visas being in force only if the F/S attends school full-time. F/S shall be required to pay tuition, housing and related costs such that all their educational costs are fully reimbursed to the institution attended. The originating country shall pay for any and all loss caused by students while on U.S. soil.

17) Border Violators seeking emergency medical treatment shall provide pictures, fingerprints and DNA samples along with country of origin, and shall be treated then incarcerated until information provided can be verified. Originating country shall bear the costs of medical treatment and confinement.

18) Children born in the U.S. to border violators, illegal aliens or of foreign nationals in the U.S. for any reason (including temporary visitor, school or work visas,) shall not be eligible for citizenship as circumstances of birth, nor shall the parents or parent’s family members (relatives) be conferred U.S. citizenship as a result of such births.

As the wonderful young lady who is running for Governor here indicated we simply cannot continue to providing all these free handouts and services to every one who wants to come here. We can't support them and more importantly, we can't afford it. Its just too bad the elite in America is more concerned with pandering to illegal aliens than taking care of our own. Prop. 187 was ahead of its time. And the AZSC's ruling will help to spur the initiative to end programs subsidizing illegal aliens that's being considered for the Arizona ballot. I believe it will pass by a thumping margin.

What is really irking is that Mexico is a very wealthy country with very large oil reserves, being part of the same land mass it has the same other natural resources as we do --- but the greedy class over there has no intention of paying for their citizens and actually promote them coming here for the handouts. We should be billing that government for all these costs. Let them pay in oil for the high cost of their illegals.
