However if linux had a license like THIS one rather than the General Commie Virus(GPL) it could have still been a free community project but not have gotten into the mess it is in now. (And it is STILL in that mess no matter what your
single slide out of many shows.)

FREEDOM PUBLIC LICENSE

Because of certain features of the GNU GENERAL PUBLIC LICENSE contribute to intellectual property infringement litigation that can have a devistating effect on open source software and allow source codes under it to transfer too easily into the wrong hands such as terrorists and the nations who aid them the need for a new type of Open Source License has arrisen. The FREEDOM PUBLIC LICENSE is designed to both protect the right to make source code free those who wish to bug fix, modify and customize their own software and support community style development of software while being friendly to proprietary closed source developers as well. The FREEDOM PUBLIC LICENSE is also designed to allow for the cross licensing of both open source codes and patents under it and proprietary source codes and patents so that infringement litigations can be avoided in most cases and to allow government restrictions on the on the nations and organizations who have access to open source code from servers in their soverign territories.
Anyone who wishes to use this license for the publication of their software as Open Source software is free to do so.

SECTION I - End User License Agreement.
1.a Executable Software - Anyone who receives executable software published under this license is free
to run it on as many computers as he legally owns. There is no "per seat" licensing restriction.
1.b Decompiling, Dissasembly or Reverse Engineering - Anyone who receives executable software
published under this license is free to decompile, dissasemble or reverse engineer the software.
However any source code resulting from such activities if it is to be published must be published under
this license's Source Code and Dirivitive Works Section (SECTION II). Any executable software
compiled from such code must also be published under this license's Source Code and Dirivitive Works
Section (SECTION II).

1.c Graphics and Trademarks - All unique graphics and trademarks in any software package published
under this license are the intellectual property of the company or development community that
published the software. They shall not be used by third parties without the express permission of that
company or community involved. The company or community involved is free to add such permission
as an addendum to this licence.

1.d Indemnification of End Users - Any intellectual property infringements against software published
under this license are the responsibility of the company or community committing the infringement.
The infringing company or community SHALL NOT attempt to put the liability for their oversights or
wrongdoing against the infringed party on end users who have obtained the software in good faith.

1.e Warrentee - Companies and communities who publish software under this license are free to
provide warantees to their software if they wish. Such warantees may be published as an addendum to
this license. If they do not do so than the fallowing non warentee statement applies to the product.

WE HOPE YOU FIND OUR SOFTWARE PRODUCT USEFULL. HOWEVER WE OFFER NO
WARRENTY OF FITNESS FOR THE USE OF THIS PRODUCT NOR FOR LOSS OF POTENTIAL
PROFITS OR COMPUTER DOWN TIME RESULTING FROM THE USE OF THIS PRODUCT.


SECTION II - Source Code and Dirivitive Works.
2.a Any executable software published under this license must come with the complete machine readable
source code thereof either with the software package itself, as a separate package on the software
distribution media or on the Internet Site where the software is downloaded. For the purpose of
of this license source code means code written in Assembly Language, Compiled BASIC, Java, C, C++,
C#, Fortran, Pascal or any other language designed to produce executable software separate from the
source code itself through compiler-linker-native code, compiler-virtual machine code or IDE software.

2.b Source code as defined in section 2.a and any patents for software published under this license is the
intellectual property of the company or community as a whole that published the software including the
software's users. Full credit however must be given to all source code and patent contributors. Users
may bug fix, modify or customize the software to meet their company or personal needs by changing
and re compiling the included source code and not to release the source code changes if he does not
publish it outside his home or place of business. If however he should publish the modified or
customized version of the software out of his home or place of business than the bug fixed,modified or
customized version becomes a dirivitive work of the original software and its publication and
distribution is subjecct to the Source Code and Dirivitive Works Section of this license. (SECTION II).
Executable software gained from source codes gained by disassembling, decompiling or other radical
reverse engineering techneques used on executable software published under this license is also
subject to the Source Code and Dirivitive Works section of this license (SECTION II). Any third party
work that uses source code from software published under this license is also considered a dirivitive
work of that software and is subject to the Source Code and Dirivitive Works section of this license
(SECTION II).

SECTION III - Libraries, Library Function Calls and Kernel System Calls.
3.a The use of any programmer's libraries in binary form and the function calls used to impelement their
contents that are published under this license do not constitute dirivitive works under SECTION II of
this license. Therefore all libraries and library function calls published under this license are open to the
use of both proprietary closed source developers and Open Source developers under the condition that
they give full credit to the author of the libraries being used in their project.

3.b Kernel level function calls from Operating Sytems that are published under this license may be freely
used by proprietary closed source developers and open source developers. The use of such calls
do not constitute a dirivitive work under SECTION II of this license.

SECTION IV - Distribution and Service Payments.
3.a Companies and development communities are free to charge fees for boxed, rackware or mail order
media distribution, paper manuals, restricted access Internet distribution and warrentees or other
services to be provided with software published under this license. They are also free to offer these
services free of charge for religious, charitable or community related reasons if they wish to do so. In
the event that free of charge Internet distribution is being provided then restricted access sites are not
neccessary.

SECTION V - Exceptions.
4.a Cross Licensing of Patents and Source Codes - Source code and patents normally covered under
SECTION II of this license can be excepted from it for purposes of cross licensing with normally closed
source proprietary code for the purpose of litigation settlement or for trading code and patents between
open source and closed source companies or communities.

4.b Restricting Open Source Access to Terrorists, Nations who Aid Them and Other Potential Enemies.
SECTION II of this license can be excepted for government based restrictions on the nations and
organizations that should be allowed to access open source code over the internet or buy open source
products The use of this exception is also to be encouraged privately as well.

I'm sorry CS, I don't follow you here. SCO has filed a suit against IBM, but has not yet challenged the terms of the GPL or any other open source license in court.

However, they have made press releases that conclusively state that the GPL is invalid under U.S. copyright law and that many business and governmental agencies owe them royalties. Neither of these claims have been supported by pending lawsuit much less proven in a court of law. The FTC frowns on the practice of demanding payment based on unproven claims.
