Federal judge says he may delay California's Oct 7 recall

(San Jose-AP) -- A federal judge in San Jose says he may decide to postpone California's October recall vote.

US District Judge Jeremy Fogel heard from civil rights groups earlier today. They argued that the quick election is forcing changes in the voting process that require federal approval.

Under the federal Voting Rights Act, any changes in the voting process must be pre-cleared by the Justice Department in places like Monterey County that have a history of low voter turnout.

Fogel set a hearing for August 29th. He suggested he may delay the election at that hearing if federal approval hasn't happened by then.

Also today, Fogel ordered Monterey County not to mail out its overseas ballots until the issues are resolved.

NO! It's like the LIBERALS have declared war on America - they are like children having a temper tantrum because they can't get their way.

They want this delayed until March - the dem primary - when more dems will vote and save Dufus.

Once again a liberal democrat Federal Judge, is doing his damndest to prevent Military Personnel to participate in the proccess they put their lives on the line regularily, in defence of.

And .. we have one of the largest military forces in our state; a great deal of whom either went to Iraq or are still there.

This smells like a Carville stunt re the Monterey ballots.

A bunch of democrats (trial lawyers/ACLU) brought the suit to delay the election specifically before this democrat-appointed judge ....

I wouldn't be suprised if the 9th Circuit Court of Appeals voids the Recall election.

Ugly thought, but I wouldn't bet against you. Keep in mind that The Rapist is masterminding the California effort.

Yeah, I think they probably want to delay recall until November at least, but what the hay, go ahead and do it, just vote on everything and everyone all at once, make it a general election day in California.

But the court fight -- forum-shopping courts and judges with federal grant money and Southern Poverty Law Center funds is a Left habit on defunding which conservatives and Republicans ought to place a very high premium. We need to break this 'Rat mechanism.

One of the reasons they have "poor voter turnout" is due to the fact that a significant number of the "residents" are not in fact citizens, nor are they in the country with the leave of the citizenry. So, uh, they aren't supposed to be voting in the first place.

Little detail that the original consent agreement ignored.

Federal judges do not campaign, hence they do not receive campaign contributions. They serve "during good behavior" once confirmed by the Senate -- i.e., for life or until they retire (or are impeached, e.g., Alcee Hastings).

I support McClintock 100% he is my grandparent's state senator out of Simi Valley. However, we still can get screwed if Bustamante gets elected. My nightmare is that if he gets in then our fight against illegal immigrantion (the majority of the budget problem) is finished. If the Clinton appointee overturns 1.6 million Californians then our hope lies in that the USSCOTUS overturns the bum.

Our next goal is to recall radical liberal judges.
