Thanks for the heads up... I set the p.c. to record it and will review it when I get home from work. I think we still need answers from Shawn Cubbage who seems to be exploiting this media opportunity for all it's worth. (Don't take that as necessarily a negative comment) Last time I checked there were still no "Crime Reports" on file with SPD. "Incident" reports yes, but that's not the same as an arrest warrant(s) or charges filed with the DA. Some "I-Reports" go nowhere... some are sent to detectives if a suspect(s) can be identified and the elements of the crime established in the mind of detectives. If only misdemeanor charges seem appropriate, the victim must make the arrest since it didn't happen in front of an officer. If a felony can be established (that's where the statements made to the seven year old is critical) or a weapon was used (steel toed shoes may qualify if sustained by the injuries) detectives can file for a warrant and arrest the suspect without the victim having to use a citizen's arrest.

If victims can't or won't step up to press charges, this could all be viewed as a publicity stunt. For once, it was great to see Mulholland have to eat crow for the "real bullets" statement. I'd hate to see recall proponents made to look like whiners instead of the winners we know they are.

Lainie... thanks again for the KFI link... We listened to the interview after work. Again, it raises more questions now than answers. There's a few conflicting statements from what's been published and stated in interviews since Saturday. I'll invite any of you whom I've addressed this post to, to e-mail me (webmaster@crimewatch.us) for an audio copy of that interview. You seem to be taking this matter more seriously than most or have had constructive input.

In reviewing the call numbers I cited in my first post, I did find a report for 245 p.c. felony assault with a deadly weapon that was likely filed at the hospital and the complaint wasn't from Shawn as far as I can tell but I don't feel comfortable citing the name. The alleged felony charges mentioned on KFI today are new to the mix of conflicting information and there was no reference to the 245 p.c. report.

I'd sure like to see one of the victims come forward and tell us what they are being told by authorities that differs from what I'm getting. If there are felony charges being considered, the District Attorney needs to be advised that there is a compeling community interest in this case.

I did learn today, that shortly after the call for service was closed, Associated Press called Sacramento Police dispatch and asked to speak to the watch commander. That was one of the call numbers I cited earlier (the second if I recall correctly).

Just a minor addition to your post. If the victim of a misdemeanor assault later identifies the suspect, the victim can still sign a complaint and the case can be submitted for a warrant. That being said, people know when they have been pushed or punched. If they told the officers who responded that they were assaulted, and they provided the elements of assault, the officers should have filed crime reports, not incident reports.
