Top Silver aide pleads innocent to rape charges

ALBANY, N.Y. (AP) _ A top aide to state Assembly Speaker Sheldon Silver pleaded innocent Thursday to charges he raped a 22-year-old employee of a Democratic assemblywoman.

Michael Boxley, on unpaid leave as Silver's $130,395-a-year counsel since shortly after his arrest in June, entered his pleas through his lawyer during a five-minute appearance in an Albany courthouse before state Supreme Court Justice Thomas Keegan. No trial date was set. Boxley remains free on $25,000 bail.

Boxley, 43, was indicted Aug. 1 by an Albany County grand jury on two counts each of first- and third-degree rape stemming from incidents during the morning of June 10 at the woman's apartment after a night of partying in local bars.

Boxley's lawyer E. Stewart Jones called the case ``a concoction'' and the woman's claims ``fantasy.'' ``She's making it up as she goes along,'' Jones told reporters outside the courthouse. Jones said he would elaborate on the woman's mgtIres as the case progresses. Boxley said nothing to reporters.

Albany County District Attorney Paul Clyne said the woman had ``expressed clearly to (Boxley) that she did not consent.'' Court papers indicated the woman told Boxley to ``get off me'' and ``stop, you are hurting me.'' Jones has maintained there was no sexual assault and that the two had ``a long-standing relationship.''

According to the indictment, Boxley had sexual intercourse with the woman when she was physically helpless. Boxley, who faces a maximum of 25 years in prison on the most serious charges, was led out of the state Capitol in handcuffs on June 11. In his Assembly post, Boxley was the top legal adviser to Silver, a Manhattan Democrat.

There were allegations in 2001 by another female Assembly employee that Boxley sexually assaulted her at his apartment after a night of drinking, but criminal charges were never filed in that case. An internal Assembly investigation, conducted by another of Silver's counsels, ended without sanctions.

If Silver covered up a crime, he is just as guilty as the perp. Covering up is considered aiding and abetting the commission of a crime. That's why Martha Stewart's in trouble - not for the crime but for the cover-up.

Go get 'em, Liz!! Perhaps Sheld'n should consider retaining legal counsel as well. Any recommendations insofar as a law firm? Wait ... isn't Clinton a lawyer? Lol!!! Now that would be choice! He's probably not licensed to practice in NY State, or any other for that matter.

Slip and Fall (with the assistance of illegally imported drugs) ... that's probably where Boxley's crime fits, wouldn't you say? Hee hee. (Actually, I asked one of the attorney's here and was told that Stewart Jones is one of the top attorneys in the field of criminal law).

Sounds like his m.o. is to get the women drunk first before raping, if that's what's really the case. I wonder how many of the "free Kobe" crowd would think Boxley was guilty? I wonder how many of the "Kobe's guilty" crowd would think Boxley is innocent?

Boxley did this stuff once before, and Sheldon Silver covered it up.
Boxley took teh girl to HIS place(teh first girl) and raped her there.
She had several embarrassing details to point out that pretty much proved she had seen him in the buff.
Silver did his thing, and ala-kapoof! It all vanishes.

Second girl, Boxley took her to her own place, seems he learned not to take girls to his pad, and raped her there.
The guy did do this once before and basically learned he can get away with it.
Sheldon Silver runs the Democrat Party is the NY assembly like his own personal fiefdom. This time, however, Silver knows he's in a precarious position and stands to lose if his guy is found guilty. (Especially since it was proven he helped cover up the first incident. Yet no-one is scremaing for his head yet. I guess everyone who might do that is waiting for the results of the trial.)
Basically, this is a pattern with BOTH Boxley and the Democratic party in NY in general.
Do a crime, scream and whine, claim victimhood, smear the victim.
Typical NY Demloser playbook.

Did you hear the one about the lawyer who died and went to Hell. He was being escorted down a piping hot path of coals by a demon with a pitchfork with glowing tines when the lawyer saw off to the side an airconditioned alcove wherein was a lovely blonde with an older lawyer riding her.

The new arrival complained bitterly about the fact that the lawyer astride the blonde was known to be the worst of his generation of lawyers, and that even Hell was grossly unfair.

All the complaining lawyer had done, he whined, was be a typical Democratic 'fixer'.

Thereupon, the demon jabbed the glowing times into the complainer with the words "it isn't for you to judge her punishment!".

Question: Which is further down the path of moral degradation, the chickie bedding a Dem laywer, or the lawyer bedding a "loose" Dem chickie?

Lawyer Jones also claims large awards for personal injury due to "defective products."

Hmmmm. The rape victims were injured.

How defective was Boxley? Maybe he's got a couple STD's? Maybe he's erectically challenged? Or impaired size-wise?

Any of these would open him up to a "defective" lawsuit.

How defective was Boxley?

Just breaking on local CBS affiliate .... Boxley's attorney, Stewart Jones, claims the "victim" tested positive for marijuana and that was why "she passed out" (oh yeah)! Jones went on to say that the pill found in Boxley's jacket was Vitamin D and the drugs found in his apartment were tylenol with codeine, not considered a date rape drug. He then went on to note that his client and the "victim" were colleagues, saying the entire case smacked of political overtones.

One woman in the courtroom during the sentencing spoke highly of Boxley, saying "He is a professional African-American [as they say] and didn't need to rape a woman. He is well respected in the black community. " She went on to suggest that because the "victim" is white, that there were racial overtones to the case.

(On a personal note, I can attest from personal experience that Vitamin D is ONLY available by prescription. The human body naturally produces vitamin D when exposed to the sun. So why was he carrying a vitamin D pill in his pocket .. like I even believed that in the first place?)

Why isn't the judge putting a gag order on these people? The jury pool is already contaminated -- which is Jones' calculated objective -- with his garbage about Vitamin D and Tylenol.

BTW, love the Clinton graphic. LOL.

i agree, the first victim reported the rape to Silver instead of going to police, most likely because she wanted to protect her career interests in NY state politics, not to mention her current job. secondly I dont care about racial components to this case. this is absurd , bottom line, he is an accused rapist who happens to be african american. white men rape also and are also convicted tried and sent to prison. as for this recent second rape victim. I hope not to see her run through the mud, because she had the courage to come forward against the machine that exists. forget about dem vs. rep, this is idiot like and makes me realize how fake this whole thing can get. fact is paul clyne the albany county d.a. is a dem, and it was he who bravely seeks justice for this poor young victim, despite the fact that silver and his mob like cronies are going to try and change who is albany county da next election, i hope this thing goes national on a real significant level so silver can use this useless rhetoric he calls public service in front of some viewers who could care less about his very biased ny stronghold. let him try and run for higher office outside nys, "paul clyne for nys AG in the next election.", and congrats to Neilson the police commissioner for his work as well.
