Your post about the waitress is very interesting but not surprising to me. If I were the defense, I would interview every taxi cab driver, barber/hairdresser, bartender, and server at the local coffee shops/watering holes. These are the people that other people talk to or who overhear people taking about the news of the day.

I said on another thread that I had been giving a lot of thought about the effect of this event on this small town and the problem that the prosecution will have in finding a jury of twelve people who have not formed opinions about the guilt or innocence of the accused.

I said then that I thought that a thing like this would split the community right down the middle, with a sizable portion not knowing or caring who is right but hating what the entire thing has done to their community and their lives and blaming the accuser for the disruption. Not fair, but there it is.

This is why I think that the defense has not sought a change of venue and likely will not. They will never in any other locale get a better built in jury pool who know or know of the accused and don't like/trust/believe her.

Query: what happens if in a high profile crminal case ln a small town if they cannot seat enough jurors to have a trial. It would be a misrtrial, but could it be retried?

I thought that jurors were called by county, not town. Is Colorado different than every other state?
Eagle county's website claims a population of over 40,000 for the county. If there is no change of venue, those 40,000 comprise the pool, not the 3000 in the small town.
