Dear Fellow Car Owner: As you probably know, Governor Gray Davis recently tripled the Car Tax that all California vehicle owners must pay in order to register their vehicles. The 300% increase will take effect for vehicle registrations due in October 2003, with bills likely being mailed to homes and businesses in August. On average, this illegal tax increase will cost car owners $158 per year.
The Car Tax increase is not right, its not fair, and its not legal, and I am taking steps to assure the tax is reduced. To that end, I have teamed up with the Howard Jarvis Taxpayers Association to file a lawsuit to overturn Governor Davis tripling of the Car Tax. The courts, however, will take some time to hear the case and eventually reverse the tax. In the meantime, there are steps you can take now to prepare yourself for an eventual refund that will also send a clear message to Davis administration that you are adamantly against increasing the Car Tax.
I have attached a link to The Department of Motor Vehicles (DMV) official refund form that you can send in with your car registration materials, assuming your registration expires in October 2003 or after. This will inform the DMV that you consider the tax illegal and will be expecting a refund once the tax is overturned. Also, the more refund requests submitted to the DMV, the more pressure there will be to lower the tax without legal action.
To complete the process please:
1) Click here and complete the Refund Form for each vehicle you register; 2) Be sure to click other in box 11 and insert, Tripling the Car Tax is illegal. Pursuant to the lawsuit (case# HJTA v. DMV, Sac Co. Superior Ct. No. 3ASO3665) to overturn this tax, I am hereby requesting a refund.
3) Mail the completed form with your vehicle registration renewal fee if your registration expires in October 2003 or after;
4) Make a copy of the refund form, your check and DMV bill, and save them for your records.
Dont be discouraged if your refund is immediately denied, as it will likely take a year or more to overturn the tax. But by submitting your claim, and keeping a record of your overpayment, you will be establishing your claim for a refund. Just in time for the recall election! That and the higher electric bills will help crush Davis. His only hope is to delay the election, and hope Kobe keeps the masses distracted.
