Gov. Gray Davis' recall campaign and state Democratic Party leaders are considering two new legal options for defeating the recall.
According to sources close to the anti-recall campaign, pro-Davis lawyers are examining legal arguments that the election is unconstitutional if the governor is denied a place on the list of replacement candidates. Under state law, Davis cannot be a candidate to replace himself if he loses the recall.

Like last minute legal maneuvers will save his political hide. We shouldn't discount a friendly liberal judge finding some far our theory to thwart the recall election but the truth is when all is said and done the Democrats don't want to look like they defeated the right of the people to decide the Governor's future. As it is is just political desperation. Gray Davis and the people around him are in a state of deep denial and will do almost anything to retain power.

It's impossible to overstate the ignorance of Maxine Waters:
``We have to be careful not to get divided and allow them to take California through this fluke recall election,'' Waters said of Republicans. ``If Dianne Feinstein is talked into getting onto the ballot, I hope Gray Davis would step down.''
As you may recall, Gray Davis cannot step down. The first question is whether he is to remain governor, and the second is who will replace him. So he cannot simply give his place to Dianne F or anyone else.
I thought that was clear to anyone with half a brain ... well, I guess that rules out Maxine.

Rep. Maxine Waters, D-Los Angeles, believes that having one candidate is crucial, but when asked if that should be Davis, she responded in an interview, ``We don't know.''Who is WE?

It would make sense. The Demorats always resort to the least democratic means for achieving their political objectives.
Meanwhile, CA voters are receiving their summertime electric bills and increased vehicle registration fees just before the recall election on Oct. 7th. It's going to be a bloodbath for Gov. Davis.

Typical demo-crap! They obfuscate and deceive, and make hysterical appeals to emotion. Specious arguments are their hallmark, (i.e. the elderly and disabled may be dis-enfranchised). B.S.! Whatever happened to absentee balloting? And, I'm annoyed to no end, that some functionary, (somehow related to Laura Bush), is reportedly assisting so-called potential republican(not)candidate Richard Riordan. If that guy wasn't so sleazy, he'd forthrightly declare his candidacy (in opposition of Joseph Graham Davis) as a democrat! What filth!

That would not prevent the election. Cruz would be governor between the time of the resignation and the election.
