Lt. Gov. Cruz Bustamante claims that under the state constitution he automatically becomes governor the moment Davis is recalled. If he pushes that claim I suspect the Calif Supremes will decide it, and most are Repubs if I remember correctly, owing to Davis' Repub predecessors.

Lt. Gov. Cruz Bustamante claims that under the state constitution he automatically becomes governor the moment Davis is recalled.

According to the California Constitution, at the same moment that the results of a Governor's recall election are announced after it is certified, the name of the candidate that the voters have selected to replace the recalled Governor is also announced. So there won't be a vacancy for Lt. Gov. Cruz Bustamante to step in and fill. Of course, the Democrats could still challenge the recall laws and election in court, but it'll probably be a waste of time for them to do so.
