For years I've been convinced --- along with a majority of American's --- that doctors and other medical professionals were significantly overpaid and overcompensated. But at least their services are designed to give you the best healthcare in the world and without good health, life ain't much fun.

OTOH, lawyers are just a bunch of greedy bastards, with trial lawyers being the worst of the lot.

Many suits are settled out of court simply because it's cheaper than risking a huge $$$$ verdict. It's not justice, it's economics.

This is true for many suits brought against Doctors and big companies. How can a Doctor get a fair trial by "jury of peers" unless the jury is composed of Doctors in a similar practice? The same holds true for too many cases that involve a "jury of peers." Most jurors are going to be sympathetic to the "victim" and want them to profit from the "greedy" Doctors, companies, etc.

LOSER PAYS!!!

Loser pays isn't enough. The juries are too sympathetic to sad cases. An ob/gyn I know left practice because he is uninsurable. After 20 years of a flawless record, one of the babies he delivered had cerebral palsy. There's no evidence that he did anything wrong, but the baby is handicapped, and the jury was sympathetic.
We need both Loser Pays and Caps on pain and suffering.
