Correct me if I'm wrong, but weren't all of these things in existence when the Interstate Commerce Clause went into effect?

I believe that you are CORRECT!Perhaps it would be a good idea if a televised"Spelling Bee"sort of thing took place.The nine SCOTUS Justices would sit on a dais and that guy from Jeopardy would QUIZ them on The United States Constitution so we could all see who should be "sitting" and who should be INDICTED!!!!

Sorry, but that was part of the Constitution from the beginning. Article I, Section 8 reads:

The Congress shall have power...

...(t)o regulate commerce with foreign nations, and among the several states, and with the Indian tribes;....

However, Breyer and his ilk need to stop using Merriam-Webster's as their dictionary of choice, where "social interaction" takes precedence over "the exchange or buying and selling of commodities on a large scale involving transportation from place to place".
