I wonder what would happen if NY enacted a tax against soda consumption, ads on TV for fast food, or on obesity and the SCOTUS struck it down. Would some on this board rediscover the meaning of the 9th Amendment?

I don't think anybody here is supporting taxes on junk food and obesity. Just because some of us are talking about how bad they are, it doesn't necessarily mean we want nanny government to get involved. If somebody wants to spend their life eating Ho-Hos and Twinkies, then I say let them.
