I am aware of that. The legislative makes law. The executive promotes law. The judiciary resolves disputes at law.
When the judiciary legislates from the bench, it is usurping the power of Congress.
When the executive writes EOs that go beyond administrative matters pertaining to executive areas (agencies), it is usurping the power of Congress.
We have had a great deal of both of the latter in recent times.
