Such negligence is actionable. This LEO needs an immediate reassignment to the gymnasium washing towels. Then, after the ensuing legal problems have subsided, booted out on her rather ample backside.

No, the perp was obviously under control from that 300-pound uniform on his back. He was no longer a threat and she should be charged with aggravated assault with a firearm just like you or I would have been had we shot at a person who was no longer a threat.

What the heck was that? I know almost all police shootings are rule justified, no matter WHAT the circumstances, but I can't see how they could even come close to ruling that one justified.
Not only should she be fired, but I don't believe charges should be out of the question here either. Reckless endangerment, at the very least.

Man, this is old. I saw this in the police training academy in 1990. The female officer was put on leave, and transfered to a desk job where she was eventually "drummed out" of the LVPD. She was also sued for like, 10 years.
The reason for the accidental discharge (not such a thing IMHO) was that when she drew the newly issued pistol (Beretta 92), it was in single action mode, and she stupidly put her finger on the trigger in which caused her to then discharge the gun. Notice I said SHE and not the gun discharged.
The holster apparently would not hold the pistol properly while the hammer was down, so LVPD kept the new Berettas on single action mode all the time.
After this incident, early in the 90's almost all law enforcement officials were shown this video and alot of them decided to change to double-action only guns or different holsters. OF course none of the above action would be necessary if the proper rules of safety were applied, and those rules included in police academies concerning drawing your service pistol.
The black guy is now (or was in 2002) the BPOA rep for NV and public relations officer for the LVPD. He is also one BIG dude and is still asked about this event. He was pretty irate, as he should be. This woman was known to be an idiot and this wasnt her first potentially harmful "accident".
The perp, of course, sued and won a substantial amount of money ( I think it was $5 or $7 million). He was wounded in the face by the ricochet, and the initial charges of DUI, pot possession, and fleeing were plea bargined to misdemeanors.
This is one of those cases caught of video that had substantial effects on the rules of lethal force, the equipment training, and legal aspects of improperly trained LEOS that made its way around the nation. If your police department has DAO (Double action only) guns, this video might one (if not the only) reason they have them.
