I'd say rather that it's a tiny step sideways. The SC has been saying that for decades, so reiterating it can't be going "backwards".

Not gaining ground isn't the same as losing any...

Until today, the SC has never said that. It only appeared in a part of Justice Powell's opinion in Bakke where he was speaking for himself alone, not for the court.
