Texas's giant legal reform

With the support of Gov. Rick Perry, the Texas legislature this month passed what looks to us to be the most serious and comprehensive package of litigation reforms achieved at one stroke anywhere in recent memory.

Among other features, it: adopts an offer-of-settlement-driven variant of loser-pays; reforms class action certification and requires that lawyers' fees be paid in coupon form to the extent that class relief is provided that way; tightens forum non conveniens safeguards against court-shopping; protects defendants from having to pay damages attributable to other responsible parties' fault; establishes innocent-retailer and regulatory-compliance defenses in product liability law, along with a 15-year statute of repose; curbs artificially high interest on judgments; limits appeals bonds; restrains medical liability in a long list of ways including a $250,000 cap on non-economic damages; and much more.

A forceful blow against the truly evil shyster industry. I have said for years that Texas, not California, is at the cutting edge of meaningful societal change.

My favorite is that class action shysters get paid in the same worthless coupons they give us peons, instead of the millions in cold cash extortion they ordinarily steal.

This is merely the first battle in regaining our freedoms and our democracy from the clutches of the lawyer vermin.

Excellent! This is a very worthy goal, because it will not just eviscerate the trial bar, but also bleed the Democrats white, financially speaking. Vast quantities of their soft money comes from the plaintiff's bar. Smash them to bits!

Where are all of the Republicans aren't conservative enough monday-freeking-morning-quarterbacks now!!!!

Hey lets all just go crawl in a hole and forget about all of the good Republicans can do because they don't want the bible written in the origional Sumarian instead of latin! OH. I mean old English instead of modern Engkish. What the hell, lets make averyone learn all of the languages so I can feel like I am the most conservative of them all....

Good for Texas! California is still Occupied Territory, under the iron fist of enemy forces.

One exception: California lead the way in medical liability reform 25 years ago. Texas has equaled this now, and is pressing the fight for freedom on a broad front.

Legal reform began back in last two legislative sessions during President Bush's terms as Governor. I'm glad to see this continue and eventually the courts may become an equal playing field for 'justice for all'......
