Another appeals court has reversed one of Gov. Gray Davis' parole vetoes, saying Davis distorted the facts about a prisoner who may not have long to live.
Unless the Supreme Court steps in, the decision will become final in 60 days. Mark Smith will then go home, becoming the first person to do so over the objection of Davis, who has vetoed parole in almost 300 cases.

Judges say governor misstated facts in case
A state appellate court in Los Angeles ruled Thursday that Davis had misstated the facts of Mark Smith's case and had no evidence to justify his veto of the parole board's decision that Smith should go free.
