I am not sure but I do believe that Scott cannot "profit" from his crime....so all is in limbo unless there is a will. So at this point no one has the right to anything unless there was a will.
Another thing that is not clear is "personal" not real property, that seems to be nebulous in all cases and should go to the "family", that would include the diaries and journals. One more thing that is not clear is that if Laci's family purchased the items taken and have proof...were they a gift a loan....once again a gray area. I am wondering if there was a will. And am wondering why Scott's attorney is not telling him and his family to play the hand better.

Exactly! Laci and her mother were very close. What if Laci had not said anything about getting the diamonds made into one ring, AND what if Scot took them to the jewelers after Laci's disappearance? Of course, the fact that Laci's grandmother had willed them to HER means that they were family heirlooms and thus the Rochas definitely would not want the Petersons getting ownership of them.

What I don't know is whether legally that changes when/if he is convicted.

It does change if he's convicted, according to several posts I've read. He inherits nothing from the estate, and cannot profit in any way from it. It all goes to her family.

If anyone watches any of the court shows, the rings given to a bride are the brides. Plus diamonds given to Laci by her grandmother?!?!

I think the diamonds are from Jackie Peterson's grandmother. At least that's how I read it.
