KCRA3, Sacramento, reports that MG has filed a motion to have the Stanislaus County DA removed from the case. Also bar witness testimony from anyone who was eavsdropping on the attny/client telephone tap and any leads derived from those taps.

Guess he doesn't trust that the Da did not listen to the conversations between Snotty and his lawyer...DA ordered those 2 conversations sealed so they covered their a$$es on that one...will be the judge's disgression, doubt that MG will win this one. The only other thing he would have asked for was a dismissal of charges, so I'm guessing it wasn't a great error on the part of LE..
DA made sure he covered all the bases on this one. I said it before, they already have one unsolved high profile murder in Modesto..this one has touched all of the Nation's hearts and I don't think they would have made one mis-step in this case....

Seating for this Tuesday, June 3, 2003 hearing will be first-come, first-served until the courtroom is full. There will be no special court credentials issued for Tuesday. There are 70 seats in the entire gallery of Department 5 - Judge Beauchense. This hearing is a civil matter previously filed regarding sealing of initial search warrants.

BTW, MSNBC just now reported that the defense says that they had wanted to catalog Laci's SHOES in the house, but now, alas, the Rochas have taken them.

Now why would the defense want to catalog HER shoes?

Aha! I thought Geragos might try something like this. The DA, Geragos might argue, demonstrated his "bias" when he and the police failed to prosecute the Rochas (and announced that they wouldn't prosecute) for the "burglary".

Even more, the wiretap stuff, in which the attorney's calls got inadvertantly wiretapped--Geragos is gonna be making hay out of that.
