Some lawyers have said it's not Scott's house while he is accused of murder (if he's exonerated, then it can be)--but some folks here feel otherwise.

What lawyers? Whatever happened to "innocent until proven guilty?" California is a community property state, so upon the death of a spouse, all property becomes that of the surviving spouse.

Community property. That's what I thought. The house is Scott's, including the contents, until he is proven guilty and incarcerated. The Rocha's were in the wrong to break-in. Understandable, but wrong.
