I'm confused at what you are trying to say. The law you quote, Section 254, appears to refer to inheritance. At the end of your post, however, you say "Scott can do with his half of the community property what he wishes."

I don't know whether in CA the surviving spouse is automatically the heir of all community property. He might be; he might not be. The community is dissolved by the death of one spouse. So there should be no community property at this point. The community might be deemed to be split between the surviving spouse and some other possible heir, such as Laci's parent(s). What belonged to Scott before Laci's death still belongs to Scott.

The earlier sections specify that upon the death of a spouse, one half of community and quasi-community property goes to the dead spouse, and the other half goes to the surviving spouse, unless there are other arrangements made in advance - 60/40, 80/20, etc.

Scott has not been stripped of his rights to his half of the community property, and will not be stripped of those rights unless and until there is a final judgmenet of conviction or a court ruling to that effect. For example, if he sells the diamond ring, and is later convicted, he owes Laci's estate half the value of the ring.

I don't get it about the duct tape. If someone wrapped her in duct tape, then maybe some of it still adhered to her body--even though (pardon the gruesomeness) most of the skin didn't still adhere to her body?

I suppose the duct tape might just have been stuff that was dumped in the bay and was floating around and got tangled on her body, but if it is the exact same type of tape as that found on the baby, then it's very likely that the tape came from the killer.

I just can't picture what the tape must look like, or how it was still attached to the body.

Me too! I miss all the good stuff, I mean. I'd give anything to be able to watch a few LOCAL reports on this case. Thanks to those of you who bring them here. Local reports are sneered at by "big" newspeople, but they are chock-full of facts (or attempts at getting the facts) compared to the two-second soundbites of cable news.

The cable news channels seem to think that they have some sort of high-and-mighty image to protect--so they usually can't just report on the facts, but have to make some high school regional debate championship out of it. (That the cable channels would think they even HAVE some sort of high-and-mighty, or dignified, image to protect, is even more laughable.)

Spunky I believe that the house SHOULD be in legal limbo right now because if he is convicted then according to Nancy Grace and that defense pr-cik Chris Pixley agreed that the entire value of the house would go to Laci's family. Scott as a convicted murderer is not entitled to anything.
