Section 251 is the joint tenancy section. It is NOT subject to Section 254 and the final judgment or conviction. Sec. 251 just says if one kills the other he can't take the property. Says nothing of a conviction being necessary, leading me to believe that all joint tenancy assets are effectively frozen until the matter is resolved.

You need to look at Section 254 - it sets up the standards by which the Probate Court can determine whether or not one has feloniously and intentionally killed the other for the purposes of the prohibition on inheritence.

254. (a) A final judgment of conviction of felonious and intentional killing is conclusive for purposes of this part.
(b) In the absence of a final judgment of conviction of felonious and intentional killing, the court may determine by a preponderance of evidence whether the killing was felonious and intentional for purposes of this part. The burden of proof is on the party seeking to establish that the killing was felonious and intentional for the purposes of this part.

Paragraph (b) only applies in a situation like OJ's - he did not get convicted, but was determined to be liable for the killing by preponderance of the evidence in the wrongful death suit.

Absent a conviction or a court ruling under 254(b), Scott can do with his half of the community property what he wishes. An accusation and indictment is not a final judgement of conviction or a 254(b) ruling.

Just a little update for your legal skills. That SODDI Defense is now know as the Tyrone Defense (TD). The defense counsel shows witnesses a picture of Tyrone, instead of the defendant. They ID him as the perp. Defense counsel then dramatically flips picture over and tells the judge, "Wasn't the defendant, your honor. It was Tyrone." (Pronounced TY-roan).

I think you're right - the only thing he loses outright if he's convicted, aside from what he would have inherited from her, is his interest in any trust in which she has any interest at all:

250. (a) A person who feloniously and intentionally kills the decedent is not entitled to any of the following:
(1) Any property, interest, or benefit under a will of the decedent, or a trust created by or for the benefit of the decedent or in which the decedent has an interest, including any general or special power of appointment conferred by the will or trust on the killer and any nomination of the killer as executor, trustee, guardian, or conservator or custodian made by the will or trust.

Dr Baden says that it's very telling that the body of Connor was in such good condition that the officer that observed the body thought it was a 2 day old baby..and the area that Connor washed ashore was very jagged much like Coney Island and that the cut on the baby was probably caused by being pushed against the jagged rocks, wound did not show jagged marks like it was cause by sealife...Connor was protected by mothers woumb till about 24 or so hrs before washing ashore...
