If it was up to me any captive that is not in a uniform should be shot in any war.Dont go to war if you dont have a uniform.Even in our revolution our troops were wearing colors that said who we are.

Most of the prisoners in Gitmo are from Al-Queda, a criminal organization not representative of a formal government.

The Taliban used a non-descript uniform that was only identified by a blue head dress. Hard to tell military personel from civilian.

Regardless of what the military wore or looked like, criminals are tried under a completely different set of laws according to Islam.

Hanging, stoning, beheading are all appropriate sentences as the religious ramification, no entrance into Paradise, is the goal.

After the executions, the corpse should be wrapped in pigskin and buried.

True only of the regular troops on both sides.

In the South Carolina back country the war was fought mostly by Tory and Patriot irregulars, neither of whom wore uniforms.

In a few battles this lack of uniforms worked to Patriot advantage as they were able to infiltrate Tory lines and use surprise to win victory.

That is exactly right. "International law" with regard to warfare has always been clear about this: combattants not in uniforms clearly identifying themselves as such can legitimately be considered to be spies or sabbateurs, and are thus fair game for summary execution. They can also be detained and interrogated prior to execution for as long as necessary or desirable.
