We protect minors. That is why bars have to ask people for ID before serving them - they can't just ask "are you 21?". We have a specific law making an alcoholic beverage dealer responsible for verifying the age of their customer.
Pornographers who pay their actors must verify the ages of their employees. That is employment law.
Unless there is a specific law making a photographer responsible for verifying the age of the people he photographs, he can reasonably rely on their word.
If you don't like it, try to get a law passed.
Just what the World needs, another law governing personal behavior.

Unless there is a specific law making a photographer responsible for verifying the age of the people he photographs, he can reasonably rely on their word.There's a big difference between photographing a fully clothed young person and photographing a young person who is either partially or completely naked. The smart thing for a photographer to do, if he wants to avoid legal problems resulting from photographing a young person who is displaying any nudity, is to ask to see that young person's ID to verify their age. Relying on a person's word about their age can get you in a lot of trouble.

There's no need for another law. The charge is that these guys filmed the girls engaging in lewd acts. That makes the filmmakers/photographers pornographers, which means they were obliged to get proof of age. Otherwise, they would be liable for breaking laws against child pornography. And so, they are.

There are no laws against "public" photography. But there are when the GGW people take them into a room. It is then they must sign a model release. But how do you verify the age of kids who can get fake ID's?
And the next ?? is how did these 16 and 17 yr olds get drunk anyway????
What is all comes down to is PERSONAL RESPONSIBILITY. The GGW crew are responsible to check to the best they can the ages. The girls themselves are responsible to not DRINK, and not appear on tape. And the PARENTS are responsible to know what it is their kids are doing and not letting under age girls go to these events.
