I guess I'm just thinking that someone out in the public might have come forward and refuted some part of their evidence if it had become public knowledge, and that Scott could say MPD and the judge were in collusion.

No, I really don't think so. Judges have a suit-proof shell thicker than an alligator's skin around them, as to the performance of their judicial duties! Otherwise, heaven knows, judges like that loony Rose Byrd who used to be on the CA supreme court would be bankrupt by now! Not to mention Ito! D.A.'s are also protected by immunity, as long as they are performing their duties.

Scott's only remedy if he loses this trial will be the usual appeals and habeas corpus-style actions. If he doesn't lose, his acquittal will be deemed to be enough remedy for him.

As for the Bee, sure, they can join in the suit to get the stuff unsealed, but that's not a suit for damages, that's a suit to get the stuff unsealed. Their rights only go so far, and STILL, this is not about the press! The bottom line is, this murder and its aftermath did not come into being so that the press could have good stuff to report on!
