I guess I'm just thinking that someone out in the public might have come forward and refuted some part of their evidence if it had become public knowledge, and that Scott could say MPD and the judge were in collusion.

No, I really don't think so. Judges have a suit-proof shell thicker than an alligator's skin around them, as to the performance of their judicial duties! Otherwise, heaven knows, judges like that loony Rose Byrd who used to be on the CA supreme court would be bankrupt by now! Not to mention Ito! D.A.'s are also protected by immunity, as long as they are performing their duties.

Scott's only remedy if he loses this trial will be the usual appeals and habeas corpus-style actions. If he doesn't lose, his acquittal will be deemed to be enough remedy for him.

As for the Bee, sure, they can join in the suit to get the stuff unsealed, but that's not a suit for damages, that's a suit to get the stuff unsealed. Their rights only go so far, and STILL, this is not about the press! The bottom line is, this murder and its aftermath did not come into being so that the press could have good stuff to report on!

What's it to THEM, whether Scott's guilty or not, whether there's evidence or not?

Just being a Pollyanna here, but I would hope that justice is what we are all seeking. That's what I really hate about criminal law--it's not about justice, it's about getting a criminal free--often by pointing at someone innocent--like a phantom cult. I heard Geoffrey Fieger say that he NEVER asks his client if he did whatever he is accused of. Must be a no-no in that profession. It's a game to them--who can make the most points. And this latest ploy to send Geraldo out is to "level the playing field". Makes me livid. That's why I try to think through what's going on and figure out what they (meaning defense), could possibly come up with next.

Regarding the middle easterners, I felt *very* uneasy. Then I felt really crappy for feeling uneasy, as if I was prejudiced.

I am blue eyed English Irish but the family that raised me was Filipino (first generation American).

The only thing I can add is I am the last to judge someone do to ethnicity.

However I grew up in a predomently Black school system and that led me to raise my son in predomently white town. The culture of hate was not a good thing being on the receiving end.

The Christian blacks were cool it was the Muslim ones that hated whitey and they put the pressure on the Christians. We also had Italians that hated the blacks/mexicans/filipinoes so those families would not allow their kids to be freinds. There was a very small group of Heinz 57 kids that hung out together.

I have found it best to get to know an individual having been on the get my butt kicked for being a honky on a regular basis.

But the 9/11 thingy made me leary of Muslim Men. I am still not a happy camper around the Farakhan Muslims.
