A completely different question is at issue here. A fire department would be acting in the performance of their mandate if there were a fire. If not, they ought to have a valid reason to be there.

I must assume that this is a part of a single thought. It's hard to tell though, as you are posting like someone not entirely in command of his facilities, but yes, I'd support the premise, that if the cops commit a 'techicality', then an obviously guilty man must go free. It is this very concept that keeps us even marginally safe from massive abuses of power.
The very concept of 'tainted fruit' as it relates to evidenciary (sp?) relavance protects all from the likelihood of 'rogue elements' being able to unjustly railroad people.
It is just that a thousand guilty should go free to protect the innocent from unjust imprisionment.
