Jefferson was unhappy because the Federalists had managed to load the courts with Federalist judges during the Washington and Adams administrations, including the so-called Midnight Judges appointed just before Adams left office. John Marshall, selected by Adams, first established the rule that judges can throw out legislation as unconstitutional...but that remained a rare thing until the 20th century.
