Jefferson said that...not Madison or Adams?...Jefferson was so much like Bubba..in some respects. Source...Federalist Papers???

Jefferson was unhappy because the Federalists had managed to load the courts with Federalist judges during the Washington and Adams administrations, including the so-called Midnight Judges appointed just before Adams left office. John Marshall, selected by Adams, first established the rule that judges can throw out legislation as unconstitutional...but that remained a rare thing until the 20th century.
