Her kid could have any name she chose to give him, marriage or no marriage. I think more likely she was just emotionally unstable, and Allman probably was promising to go clean and then immediately after the wedding went on a major drug binge. Just I guess -- I have no clue how such people's minds work, but worrying about whether their children are technically "legitimate" wouldn't seem likely to be a major priority.
