The judicial power of the United States rests in the Supreme Court, not the Federalist Papers.So, the legislative power of the US rests in Congress, but that doesn't change the fact that he wrote, 'the confederacy may be dissolved, and the confederates preserve their sovereignty.'
Just as an aside, the Federalist Papers are frequently mentioned in SCOTUS decisions.
