To that point, however, I would like the United States Constitution amendment to specify declare something akin to the following:
The President of the United States may declare a finding to the Congress of a Critical Homeland Security Threat. Such a finding, confirmed by 3/5ths majority of either house of Congress, authorizes to the President to act to defend the United States against such Threat, using any and all means available, regardless whether the threat is foreign or domestic, or a sovereign nation state.

In other words, let's declare it our sovereign right to act - even pre-emptively if necessary - to defend our interests.
