You have done such a good job covering this case I will cede to your local knoweldge here, but arent the Smarts asking for the DA to exclude the assault evidence for juvenille privacy reasons (understandable, since Mitchell will get life on kidnapping times 2 for the other cousin )

And does LE have to honor the family's wishes if Elizabeth won't testify because it is too hard for her (ie assault/torture evidence)

The Smarts did ask, the DA didn't grant their wishes. Two counts of aggravated sexual assault, two counts of aggravated kidnapping, and two counts of aggravated burglary have been filed against Brian David Mitchell and Wanda Barzee. I will find you the transcript or at the account of the DA's press conference where he said that the sexual assault charges were filed and why they were filed. They would try to cause the least amount of stress to Elizabeth, but that the charges would stand. And that they would work with Elizabeth, but that she would have to testify.
