Stone Mountain: Actually, I believe this is a right, declared constitutional by the Supreme Court.
SCOTUS doesn't establish rights. SCOTUS doesn't declare something constitutional. SCOTUS, as one of the three equal branches of our federal government, may determine, for example, if legislation is constitutional. In 1990, SCOTUS struck down legislation that would have made it illegal to deface, burn, etc., Old Glory.
That's a far cry from saying, Have it, you anti-American idiots. It's your right to do so.

I'm not sure I get your point. Are you saying that it's not a right, but it is legal? If that's the case, what is the point of such a distinction?
