Yes, but UN or not, the Liberals could bring up charges based on Bush violating the executive order banning assasinations, and that's a constitutional issue, not a UN issue. So the question is, was war declared or not, and can a head of state ALSO be considered an enemy combatant

If all goes as planned and the Iraqi's are enjoying their new found freedom fairly soon, I think it would be political suicide for the liberals to start anything about war being declared or not.
