Senate Backs 'Partial Birth' Abortion Ban

WASHINGTON (Reuters) - The U.S. Senate on Thursday easily approved a controversial ban on a procedure critics call "partial birth abortion."
The bill must go to the House, where it is expected to pass easily. President Bush has said he will sign it.
Congress has passed a ban several times since 1995 but then President Bill Clinton vetoed it, citing its lack of an exception to protect the health of a woman.
Critics of the bill say it is unconstitutional because it lacks a health exception and is vaguely worded, meaning it might forbid other abortion methods as well. A court challenge is likely.

When will conservatives learn?
First write a bill so narrow and so clear that it will survive court challenges without question and pass it, even if it isn't but a fraction of what's wanted. Then go back the next year and the next and the next adding incremental slices each time until it is all there.
Overreaching and being overturned accomplishes nothing but making conservatives look like radical loons.

This may be a trick by the Democrats to have the Republicans withdrawl the Estrada nomination so that they can vote on this. Once he is withdrawn the Democratic support for this legislation will mysteriously evaporate.

The United States Senate has passed the partial Birth Abortion Ban by a vote of 64-33-3.
The House will pass a similar measure, it will then go to conference, and the President, George W. Bush, will sign this bill into law later in the Spring.
Unlike that baby killer supporter President clinton from the 105th Congress.
(If you recall, The Senate and the House passed this bill in the 105th, but clinton used a veto to stop its implementation)
Two of the benefits of this bill are:
`(2) the term `physician' means a doctor of medicine or osteopathy legally authorized to practice medicine and surgery by the State in which the doctor performs such activity, or any other individual legally authorized by the State to perform abortions: Provided, however, That any individual who is not a physician or not otherwise legally authorized by the State to perform abortions, but who nevertheless directly performs a partial-birth abortion, shall be subject to the provisions of this section.
`(c)(1) The father, if married to the mother at the time she receives a partial-birth abortion procedure, and if the mother has not attained the age of 18 years at the time of the abortion, the maternal grandparents of the fetus, may in a civil action obtain appropriate relief, unless the pregnancy resulted from the plaintiff's criminal conduct or the plaintiff consented to the abortion.
Finally, someone respects the rights of the co-creator and equal partner in the creation of the child, the Father.
Score one for the side of good, and strike one down for the forces of evil, IMHO. [Big Grin]

If you pass more than you can sustain in court you have overreached ... You're absolutely right. However, I believe that theres's a good change that this Supreme court will uphold this law (5-4). I believe O'Conner would be the swing vote.

The fact this finally came to a vote in the Senate illustrates why the recent Republican majority was so important.
Now, let's get the Bush judicial appointments confirmed and on the bench to make sure good laws such as no partial-birth abortions don't get nixed by liberal judges.
