Nissan Car Company tried to do this same thing. They sued a man who used his last name for a website nissan.com before nissan registered their own domain thingy, whatever it is... domain name? Anyway, it's been done.

The lawyers beat you to it.

If you haven't seen the movie "Coming to America" with Eddie Murphy, you'd love it. There is a running joke with a character who owns a hamburger restaurant called "McDowell's."
