A lawsuit filed six months ago against a Palm Springs resident whose cigar smoke bothered his neighbor appears headed for trial.
A judge in February overruled most of the legal challenges filed on behalf of Edward Babbitt, who was sued by his neighbor, Joseph DiPuzo.

Babbitt said he doesnt understand how he can be sued for smoking on his own property. This is Amerika, you can be sued, arrested, and detained for just about anything nowadays.

I guess if I'm a tree hugging environmentalist and I notice the scent of burning hickory and see smoke coming from my neighbor's chimney, that neighbor's getting sued. The smell of burning wood is personally offensive to me! </sarcasm>
