If a recess appointment is not made I will be very disappointed in Frist for backing down. I agree.
The only other reason for them to recess is because of the terrorist threat. If we are expected to go on about our business as normal, then we have a right to expect the same from them.

When you say "this confirmation vote," are you referring to the one that would be required at the end of the year's recess appointment....I am referring to the confirmation vote for the recess appointee, at the end of the recess appointment term.

I wish I did have a reference, but I do not. I was hoping that one of our super parliamentarians out there (Freepers collectively seem to possess an awesome skill set) might be able to confirm (or deny) this supposition.
I do know that I read or heard this about some recess appointee some time ago, but in fact that might even have been back last century.

5 U.S.C. § 5503
Sec. 5503. - Recess appointments (a) Payment for services may not be made from the Treasury of the United States to an individual appointed during a recess of the Senate to fill a vacancy in an existing office, if the vacancy existed while the Senate was in session and was by law required to be filled by and with the advice and consent of the Senate, until the appointee has been confirmed by the Senate. This subsection does not apply -

I watched in on T.V. that day, LOTT was down "in the well" hugging on DemocRATic senators like they had just saved his life or somthing. It was unreal!It was totally bazarre!!

I think this will return. There's just not enough votes to terminate the filibuster and from what I've heard, Republicans have already begun airing ads on hispanic radio about the dem's obstruction. The word is getting out and hispanics are already angry. These democrats may return home to the anger of their hispanic voters. I think this has legs and will yet be won; I have faith that Frist will not slink away from a dem.
