So if no one goes to prison for it, why keep it illegal? Isn't that just wasting resources?

Uh look up the word stigma in your dictionary. But you go ahead with your, IMHO, naive Libertarian/ACLU view that stigma is a "four letter word".

Be careful with your wish of the "idealistic" world you propose( where there is no such word as stigma), you may get what you want and not like it. Don't come complaining to me about the outcome.

Non sequitur; there are ways of maintaining stigmas other than through criminal law.

There used to be a stigma towards inter-racial marriage. Was it ever illegal? I don't think so.

How about being gay? That usually carries a heavy stigma, but it's not illegal. (unless you count the un-enforced sodomy laws)

Heck, being an insufferable asshole carries a stigma with it, but you sure aren't in jail now, are you?
