it all depends on the law of the particular state. Some states have 'age of consent' laws that allow a man to have sex with a 16 year old girl if the man is only 3-5 years older than the girl. But each state has different laws. I'm sure in some states even an 18 year old man could go to jail for having sex with his 17 year old girlfriend.
