You don't call your opponents racists in a court brief. Oh, that would go over real well with the Scotus...lol
The brief will state that affirmative action quotas are unequal and discriminatory. It won't resort to name-calling.
That is our job, not the job of the legal folks.

All that would do would be to cite the obvious while alienating people who we're trying to reach. Bush meant what he said when he said that he's a uniter and not a divider. Let's leave the divisiveness to the democrats.
