Read post #6... the kid was trying to get those in the class who were reciting to stop.. during The Pledge. His Rights weren't being violated, he was being sent in the hall for disrupting class, interrupting others, and generally being a little jerk. If he wants to start discussions about the flag or the necessity of reciting The Pledge, he can do it on his own time, and without interrupting others who are reciting it.

Didn't see that the "disruptive" behavior occurred during the pledge. But, since the report does say...
"...Woodbury was disruptive and tried to incite other students not to say the pledge, according to Burke's written report."

I'll endorse the action of the teacher - put the little jerk into janitor's closet for an hour or two. I'll bet jihad Johnny has some nice folks, eh?

And that must be true because the teacher wouldn't lie to try to cover his own ass after discovering that what he did was illegal.
I'll withold judgement until I hear more information.
