Kevorkian Wants Out Of Prison Due To Poor Health - Lawyers Say He Is Frail, May Die

CINCINNATI -- A federal appeals court in Cincinnati has canceled today's hearing on whether Doctor Jack Kevorkian should be released from prison because of poor health.

The 74-year-old advocate of assisted suicide had asked the court to release him on $750,000 bond. But his lawyers filed a request for dismissal of the hearing last month, and the court granted the motion last week.

Kevorkian's lawyer, Mayer Morganroth, said he recently asked the U.S. District Court in Detroit to overturn Kevorkian's conviction, not just to have him released.

He said they withdrew the request in Cincinnati because it would overlap with the one in Detroit.

The Michigan doctor is serving a 10- to 25-year sentence for the 1998 injection death of a man who suffered from Lou Gehrig's disease.
