This ruling by the Ninth Circuit is in direct contradiction to the ruling by the Fifth Circuit. At some point soon the SCOTUS will have to resolve the differences between these two circuits. Now anyone who has paid attention knew that the Ninth Circuit would take the collective rights stand. It looks like it will go to the Supremes and we shall see what they rule. If the SCOTUS does not uphold the individual right then I would suggest we are no longer in the awkward time.

I concur with your statements. It would not surprise me, however, if the SCOTUS exhibits it's honored tradition of spinelessly shying away from such a decision, as they did with Solicitor General Ted Olsen's assistance in the case of U.S. vs. Emerson.

I have heard statements that waiting a bit longer in order for GW to appoint a couple of conservatives to the Supreme Court would be good here. I would rather have this issue decided on NOW, since I feel we already have a sufficient strength in the SCOTUS to decide rightly on this long-suffering topic.

I think this decision is wonderful.

Without it, the Supreme Court would be unlikely to address the issue, and it's certainly time to do it.

Timing is the question. There will be retirements in the Court and nomination battles. Whether this case will be heard before any of those retirements is the question.

I would certainly prefer Stevens to be gone first and replaced, because a 5-4 decision might go either way.

Did you get to the part in the book where the young lawyer who snipes the senator says "I think the awkward time is over"? That's about chapter 20.

I would have to agree with you there.
Such a decision would cross the line,
registration and confiscation would assuredly follow.
Perhaps not right away but there would be nothing to
stop such actions then.
